The Pakistan troops yesterday beat back a company of Indian border security Force soon after it had infiltrated into the border area of Rajshahi.
Six Indian soldiers were killed and over a dozen wounded in the encounter one Indian soldier. No 1777062 Sepoy Benod Kumar of 77BSF, was captured alive along with his light machine gun and ammunition.
According to details available here, a company of 77 BSF, armed with machine guns
and other automatic weapons, attempted to infiltrate into Pakistan territory from
Balur Ghat side. They were seen by Pakistan forces who allowed them to come well
within Pakistan territory before taking them on. The encounter took place near village

These infiltrators had reportedly come for looting in the border area and disruption of means of communication.
Rawalpindi, Aug, 18 (APP): The Chief Marital Law Administrator today issued Martial Law Regulation No.88 enabling Martial Law Administrator for a zone to convene one or more special criminal courts with the prior approval of the cheif Martial Law Administrator.
Under the Regulation a Martial Law Administrator of a Zone may convene one or more special (3) Pakistan Penal Code sections 34,109,149 when in conjunction with any of the offences specified in clause (2) of the schedule.
A special criminal court shall be composed of a Magistrate of the first class or a officer of the Armed Force not below the rank of Major or of an equivalent rank, it said.
The court shall exercise the same powers and follow the same procedure as a special Military Court constitued under Martial Law regulation No. 2 exercises and follows and its procedings shall be governed accordingly except as hereinafter provided.
The Court shall have the power to award any of the sentences prescribed under Martial Law Regulation No. 4 except the sentence of death.
Explanation of offence punishable with death or transportation life shall be deemed punishable with rigorous imprisonment for a term which may extend to 14 years.
The provisions of the evidence Act 1872 except sections 121 to 126, 133 and 134 therefore shall not apply to the proceedings before the court.
The court shall not be required to record more than a criminal court and direct that any of the offences mentioned in the schedule may be tried by such courts.
The schedule is:-
(1) offences under Martial Law Regulation No. 5 6 7 8 9 10 12 13 14 17 18 19 and 20.
(2) offences under Pakistan Penal Code sections 120-
The court shall hear any evidence that may be adduced before it in support or rebuttal of the accusation levelled against the accused, which may be led by the prosecution or the accused as the case against may be.
Provided that the court may in its discretion refuse to hear any evidence which it feels is being tendered for the purpose of vexation of dealy or for defeating the ends of Justice.
United Nations, Aug. 18 (AFP): The United Nations announced Tuesday that the United States had notified Secretary General U Thant it was now "processing" a donation of 3.5 million dollars in rupees for UN relief to East Pakistan.
A Spokesman said a note containing that information came over from the US mission Friday two days before president Nixon ended convertibility of the dollar, in effect changing its value in terms of foreign currencies.
Secretary of State William P. Rogers had handed Thant a first US contribution of one million dollars for East Pakistan relief the previous Monday.
The President and chief Martial Law Administrator has promulgated today an ordinance establishing a civil commotion compensation Fund, says a press Note issued by Ministry of commerce.
This fund to be administered by the Pakistan Insurance corporation and to be fed initially by a loan from the State Bank has been created for compensating losses due to damages suffered during the recent disturbances by the industrial and commercial installations and property in East Pakistan. Appreciating that such losses were not covered by the ordinary insurance policies the Government considered it expedient in the interest of speedy revival of trade and industry in East Pakistan to establish this fund for the benefit of sufferers of such exceptional losses.
Under the ordinance, compensation will be admissible in respect of buildings, machinery and vehicles used for commercial or Industrial purpose as well as for commercial stocks and cash in safe or tansit, provided (1) these assets were protected by an insurance cover on the date of their damage or loss and (II) the damage or loss occured between certain specified dates or in the event of its taking place subsequent to the specified date, ample evidence exists to establish that it was due to exceptional causes.
The central Government has been empowered by the ordinance to prescribe the scale for the payment of compensation. While it is proposed to pay full compensation for commercial stocks, a 5 percent deduction will be made from the claims for capital assets so that a small part of the loss is shared by the managements as well the bigger enterprises thereby meeting larger amount of loss from their own resources.
The Fund will be financed by the levy at 10 percent and 8 percent respectively in the case of bigger and smaller companies of general insurance business for the year 1969. It will also be fed by a 10 percent surcharge on insurance premium payable on policies other than policies relating to personal insurance of all types, private motor vehicles, residential and house hold properties and the properties of the central and provincial goverments. Small enterprises, however, the insured value of whose assets does not exceed Rs. 1 lakh will according to a provision in the ordinance be exempted from the levy of the surcharge.
Following is the text of the ordinance:
Ordinance No. XXI of 1971 An Ordinance to establish a fund for the payment of compensation for certain losses suffered during civil commotion. Whereas,, it is expedient to establish a fund for the payment of compensation for certain losses suffered during civil commotion and to provide for matters ancillary thereto.
And whereas the national interest of Pakistan in relation to the achievement of uniformity requires central legislation in the matter.
Now, therefore, in pursuance of the proclamation of the 25th day of March, 1969 read
with the provisional constitution order, and in exercise of all powers enabling him
in the behalf, the president is pleased to make and promulgate the following ordinance:-
Short title, Extent and Commencement
1.(1) This ordinance may be called the Civil Commotion Compensation Fund ordinance 1971.
(2) It extends to the whole of Pakistan.
(3) It shall come into force at once.
2. In this ordinance, unless there is anything repugnant in the subject or context-
(A) Fund means the civil commotion compensation Fund as established under section
4-
(B) "Prescribed" means prescribe by rules made under this ordinance
(C) Words and expresssions ordinance shall have the same meanings as the insurance Act 1938 (IV of 1938).

Civil Commotion Compensation Fund.
4.(1) There shall be established a fund to be called the civil commoton fund to which
shall be credited-
(A) The sums collected as surcharge under section 5 and
(B) The sums paid by insurance companies under section.
(2) The fund shall be administered by the General Government or by any authority or agency authorised by it in this behalf.
Surcharge on certain policies.
5.(1) Every insurer who issues a policy of insurance, not being a policy of re-

policy or an insurance policy in respect of-
(A) Residential properties
(B) Private Motor vehicles
(C) Household and personal assets
(D) Capital assets of a proprietor if the total insured value of all his capital assets does not exceed one lakh of rupees.
(E) Any property owned by the central Government or a provincial Government.
Explanation: For the purpose of clause (D) "Capital Assets" means buildings, machinery including agricultural machinery, commercial vehicles and commercial vessels.

(6) Every insurer shall pay into the Fund before the 30th day of June, 1972, a portion
of the net premium receipts in respect of this general insurance business for the
year ending the 31st December, 1969 calculated as follows :-
If the net premium receipts do not exceed twenty five lakhs of rupees 8 percent of the receipts.
If the net premium receipts exceed twenty five lakhs of rupees 10 percent of the receipts. Explanation for the purpose of this section, "net premium receipts" means the amounts of premium received in respect of acceptance of risks reduced by the amount of the premiums in respect of the risks which have been ceded to other insurance of bodies carrying on insurance business.
Loans and Advances
7. The authority administering the fund may obtain such loans and advances as may be necessary to make up any defiency in the Fund in meeting the claims for compensation payable under ordinance.
Compensation for loss.
8.(1) There shall be paid out of the Fund, in such manner and to such manner and to such extent as may be prescribed, compensation for any loss suffered in respect of any insured property during the period commencing the 1st day of March. 1971 and ending the day specified in this behalf by the central Government by notification in the official gazette due to fire caused by or any destructive or malicious activities on persons taking part in civil commotion or due to any action taken by any lawful authority for the suppression of civil commotion provided that compensation may also be paid out of fund for any such loss suffered at any time after the expiry of the said period if the Central Government is satisfied that such loss was suffered due to circumstances not covered by the policy under which it was insured .
(2) In this section
(A) "Insured property" means any of the following properties which on the date of
the loss were insured against any loss under an insurance policy, namely;-
(I) Commercial stocks of raw material and finished goods
(II) Any building or machinery owned by commercial and industrial enterprises and used for commercial and industrial purposes
(III) Any vehicles or vessels used for commercial purposes and cash in safe or cash in transit if specifically insured as a specified amount
(B) Loss suffered in respect of insured property" does not include the amount of profits lost or reduced, or wages paid to workmen who were idle, or rent paid for premises damaged.
Account of the Fund to be published
9. The Central Government shall cause to be prepared in such form and at such intervals as may be prescribed on account of all sums received into and paid out of the Fund and shall publish such account in the official Gazette.
Disposal of surplus in Funds
10. If, after payment out of the Fund fall such compensation as is payable under this ordinance and the loan and advances obtained under section 7, the rermains a surplus, the surplus shall be credited to the central consolidated fund.
Survey of loss
11.(1) A loss in respect of which a compensation is payable under section 8 shall be surveyed and assessed by a person appointed for the purpose by the central Government.
(2) A person surveying and assessing any loss under subsection (1) shall be credited to the central consolidated fund.
Survey of loss
Survey and assess such loss in accordance with the principles and practices follow for the survey and assessment of any loss in respect of an insurance business.
(3) If a person appointed under sub-
(1) is an insurance surveyor, he shall, in the case of over assessment or under assessment, be subject to the same liabilities and penalties as he would have been subject had he surveyed and assessed the loss under the insurance Act. 1938 (IV of 1938).
Power to call for information
12.(1) The Central Government may for the purpose of this ordinance, by notice in writing call for such information as it may deem fit from any insurer or the person responsible for the conduct of the business of the insurer of any person claiming any benefit or performing any functions under this ordinance.

14. If the fund is administrered by an authority or agency appeal against the decision or order to the Central Government in such manner and within such period and on payment of such fee as may be prescribed and the decision of the Central Government on such appeal shall be final.
Limitation of prosecution
15. No prosecution for any offence punishable under this ordinance shall be instituted against any person except by, or with the sanction of, the Central Government or any authority authorised in this behalf by the Central Government.
Composition of offences
16. Any offence under this ordinance may either before of or after the institution of the prosecution, be compounded by the Central government or by any authority authorised by it in this behalf, on payment for credit to the Fund of such sum as the Central Government or such authority, as the case may be, may direct.
Bar of legal proceedings
17. No Suit, prosecution or other legal proceedings shall lie against any person for anything which is in good faith done or intended to be done under this ordinance.
Delegation of powers
18. The Central Government may, by notification in the official gazette direct that all or any of the powers exercisable by it under this ordinance or the rules made there under shall be exercisable by such officer or authority as may be specified in the notification and in giving such direction may provide that such powers shall be exercise by such officer or authority as may be specified in the notification and in giving in such circumstances and under such conditions as may be laid down therein.
Power to make rules
19. The Central Government may, by notifications in the official gazette, make rules for carrying out the purposes of this ordinance.

Lieut. General A.A.K. Niazi Commander, Eastern Command said in Rangpur yesterday that the enemy wanted to weaken us through internal strife so that she could grab this territory without much resistance but her evil designs were frustrated by the concerted efforts of the people and the armed forces of Pakistan.
He was addressing a joint gathering of members of peace committee, elite of the area and local civil and military officers. He was accompanied by the GOC.
General Niazi exposed the Indian game which professed to the sympathetic to the people
of East Pakistan but, in fact, was doing everything to herm their interests. Her
real aims is to grab this territory, he said and added that not an inch of our land
would be allowed to go under foreign occupation. He declared emphatically. "We will
not allow our children to live as slaves and our women be at the mercy of enemies
of Islam." He added that Pakistan is a fort of Islam and it should be defended as
such. He reminded the people of plight of Muslims due to Hindu domination in pre-
General Niazi dilated on the conflicting character of Hindu and Muslim cultures and said, "Hindu domination means death of our values". He recalled the days when Hindu houses were desecrated by Muslim's feet and their food rendered unifit for consumption of if touched by Muslim hands.
History Traced
General Niazi traced the 24 years history of independent Pakistan and drew the conclusion that Brahman India did everything to undo Pakistan. How can she, all of a sudden turn sympathetic to the people of East Pakistan." He asked and added that she was helping only the anti state elements and saboteurs who were out to ruin the economy of East Pakistan which would result in economic hardships to the common people.

Talking of the misguided trouble makers in the province the General said that action against them was undertaken with a reluctant heart because their death meant more widows and more orphans in our country. He asked the people to persuade this misguided lot to see the truth. "So far as the external dangers are concerned, we are fully prepared to thwart every enemy move," he said.
Earlier, General Niazi paid a brief visit to Bogra where he addressed a similar gathering.

A Tunisian paper "L. Action" has accused India of capitalising on the refugee problem.
In a lengthy item entitled "The situation in Pakistan: 75000 refugees have already come back to Pakistan." Published in its issue of July 24, 1971, L. Action says:
"India is capitalising on the refugees problem in order to earn political and material gains. The whole government machinery is now out to internationalise the problem with three main objectives in view, firstly, to malign Pakistan: secondly, the refugee problem gave them an opportunity to interfere in the internal affairs of Pakistan and thirdly, it is to attract international attention and gain huge amount of foreign exchange which is badly needed by India."

Maulana Kausar Niazi explained that Muslim League came into existence in 1906 but it could not achieve anything nor could it bcome an effective voice till 1940, when the people joined it in large numbers and converted the party of a handful of exploiting Jagirdars and Zamindars into a mass peoples party.
He asked as to why Mian Daultana and Khan Qayyum Khan were now making appeals to people to join the Muslim League when they did not believe in the strength and sovereignty of the people.
Maulana Kausar Niazi said that with the establishment of Pakistan, the historical role of the Muslim League had ended. Pakistan, he observed, was the creation of history, it was and historic need of the time.
He observed that even many of the heroes of independence movement who were not in the Muslim League were among the founders of Pakistan. Pakistan is not a monopoly of any one party, he added.

Islamabad, Aug. 17 (APP): The Ambassador of Indonesia in Pakistan, Air Marshal Soetopo yesterday expressed the hope that the Government and the people of Pakistan would be able to solve their own problem in the best possible manner and continue development work according to their hopes and ideological aspirations.
In a speech broadcast from Radio Pakistan on the eve of Indonesia's 26th independence day, he hoped that a strong and United Pakistan would be a source of pride for the Muslim world and particularly for the people of Indonesia, who are tied with this great country into the bonds of a close relationship. This close bond has, of course, been strengthened by the basic religious and cultural affinity existing between the two countries, he added.

This hope, he said was based on the splendid reality that Indonesia and Pakistan had singular distinction of enjoying the best mutually friendly and brotherly relations right from their inception.

The two day Islamic Brotherhood conference ended here yesterday with a plea to the Islamic secretariat and Muslim world for setting up a Muslim world peace and welfare council with its council Headquarter press release, reports APP.
Sponsored by the Pakistan peace and welfare council the second day's session of the Islamic Brotherhood conference was inaugurated by Mr. Hasan Raif, consul General of Indonesia here. Moulvi, Farid Ahmed, president of Pakistan peace and Welfare Council, was in the chair.
The Conference, according to the press release authorised the Pakistan peace and welfare council to move the Islamic secretariat and the Muslim world to set up the Muslim world peace and welfare council under the Islamic secretariat with the Pakistan peace and welfare council to be the liasion organisation for South East Asia with Headquarters at Dacca.
The conference adopted a resolution approving 16 point memorandum submitted to the secretary General of the Islamic secretariat Tunku Abdur Rahman by Moulvi Farid Ahmed recently to set up world Muslim Commonwealth.
The conference called upon "all patriotic ulema and imams." of the mosques to extend their services to the cause of peace and welfare of the people.
Moulavi Farid Ahmed in his presidential speech called upon the Muslims to help establish a common bond of fraternity, equality and brotherhood. He asked the people to sincerity and zeal for establishing a true classless society based on the principles of the holy Quran and Sunnah.
Maulvi Farid Ahmed said it was high time for us to be united under the single bond of humanity forgetting parochialism, regionalism or racialism. He said it is Islam, only Islam which teaches us to do justic to the poor, helpless people and Islam gives constant warnings of the evils of racial discrimination. Racial discrimination is not only discrimination is condemned by Islam, it is considered as a grave sin.
The session by another resolution welcomed Dr. A. M. Malik, the special Adviser to the president of Pakistan, the consul General of Iran for their kind participation in the session and congratulated the Embassy of Afghanistan, Iran Turkey, Indonesia president of Azad Kashmir Sardar Abdul Qayyum, Allama Alauddin Siddiqui, Dr. Mahmud Hossain, Dr. I.H. Qureshi.
The Secretary General of the Pakistan peace and welfare council, Maulana Nuruzzaman announced postponement of the cultural functions scheduled for August 18 and 19 till further notice due to unfavourable weather conditions and examinations being held at Dacca and elsewhere in the province.
A seven member team of Pakistan peoples party will shortly visit East Pakistan to assess the situation in the province, reports APP.
This was stated here yesterday by Mr. Kamal Hassan Rizvi, a leader of the PPP. East Pakistan on return from Karachi after attending the meeting of the central committee of the party held there recently.
Mr. Rizvi said that he had apprised Mr. Bhutto and other leaders of his party of the political and economic situation in the province.

Karachi, Aug. 18 (APP): The two visiting prominent Kenyan Muslims yesterday supported the Government of Pakistan's action in East Pakistan to tide over the political crisis.
They are Mr. Yunus Ali, a member of the Kenyan parliament and Mr. Issa Kuria, president of the National Union of the Kenyan Muslims.
Speaking at a reception given in their honour by the Motamar Alam-
Mr. Yunus Ali said that only lip service would not do.
He thought it was incumbent upon every Muslim to help their Muslim brothers in distress irrespective of caste, creed and colour.
He said the Kenyan Muslims were very concerned over the situation obtaining in Pakistan and wished and prayed for Pakistan's happiness and prosperity.
He said the Kenyan Muslims looked up to Pakistan to give a lead in the revival of lost glory and dignity of Islam and the Unity in the Muslim world.
Mr. Yunus Ali asked the Government and people of Pakistan to extend all possible support to the Phillipine Muslims in distress.
Issa Kuria said that the Kenyan Muslims were very eager to still come closer to the people of Pakistan and urged for necessary steps to help achieve the objective.
Earlier Mr. Inamullah Khan, Secretary General of the Motamar introduced the two visiting guests to the gathering.
The Kenyan leaders are scheduled to leave here today for home.
