Eviction of unauthorised occupants of land : MLR 96 issued.

Rawalpindi, Nov. 7 : The chief Martial law administrator has issued a Martial law regulation (No.96) providing for eviction of unauthorised occupants of land. Following is the text of the regulation :

1. This regulation shall come into force at once and shall take effect. Not with standing anything inconsistent there with in any other law for the time being in force.

2. In this regulation, unless there is anything repugnant in the subject or context.

(a) 'Government' means the central Government or, as the case may be provincial Government;

(b) `Land' means any land ]eased out by the government for cultivation or horse, mule, cattle and sheep breeding conditions for the army remount department and include any buildings, hut houses, sheds and shelters constructed there on or appurtenant there to :

(c) `Lease' and 'Lessee' have same meanings as respectively assigned to these

words in the Transfer of property Act, 1882 (IV of 1882) mid the term 'Lessee' shall include his heirs, assigness leagel representatives and all persons inducted by him into the land of which he is the lessee :

(d) 'Unauthorised occupants' means a person whose lease of' land has expired or is terminated in accordance with the terms or due to breach of conditions or size of his stud having been reduced by who is still in possesion of the land and includes.

(i) A person in occupation of any land without the express permission Or authority of the Government and the heirs, successor's or arrives of such a person : and

(ii) A person who has taken possession of any land from any such person.

3. (i) Whether before or after the Commencement of this regulation an unauthorised occupant of- the land refuses or Jails : to vacate that land and put government into possession of the same, any officer authorised by government in this behalf may, not withstanding anything contained in any other law for the time being in force or in any contract, at any time, enter up on that land and recover vacant possession there of by evicting the lessee.

Provided that, before such eviction, one month notice shall be served on the unauthorised occupant calling upon him to deliber vacant and unencumbered possession of the land immediately after the expiry of the said period.

(2) Notwithstanding anything contained in sub-paragraph (I) land is respect o1 which any suit or proceeding is pending in any court including the supreme

Court and a High Court, shall be taken posession of until after, and in conformity with the decision of such court or the tribunal to which such suit or proceeding may be transferred under sub-paragraph (3).

(3) A Zonal administrator of Martial Law may transfer from any Court including the supreme court and a High court in which any such suit or proceeding as is referred to in sub-paragraph (2) is pending to a tribunal constituted by him under sub-paragraph (4).

(4) A tribunal to which a suit or proceeding may be transferred under sub­paragraph (3) shall consist of :

(a) a Military officer not below the rank of a major who shall be the presiding officer and

(b) a Revenue officer or a civil judge

(5) A tribunal shall for the purpose of deciding the suit or proceeding transferred to it, under sub-paragraph (3) be deemed to be and have the powers c>1, a civil court of competent jurisdiction trying a suit under the code or, civil procedure 1904 (Act vof 1908).

(6) The decision of the tribunal shall be final and shall not be called in question by or before any court including the supreme Court and a High Court.

(7) An officer of the government shall give a notice of one month to vacating the land of which an occupant has been declared as unauthorised occupant. The period of notice shall start from the date the tribunal records its decision.

4. For the purpose of' recovering possession of any land on officer authorised by Government in this behalf may use or cause to be used such force as may he necessary.

5. If any rent payable in respect of any land has been in arrears on day of recovery of possession of such land, the amount chic on account of such arrears with interest, if any, accrued there on shall be recoverable as an arrear of land revenue.

6. The unauthorised occupant on his eviction may apply to the collector of the district in which the land may be situated, claiming compensation for any authorised buildings constructed, (other than those for private animals and their attendants, or well dug in, trees planted by him and crops uncut ungathered,on the land and the collector, whose decision in this behalf shall be final, shall determine the amount of such compensation to be paid by the new lessees of the said land, after affording such new lessees. government representatives and the evictus and opportunity of being heard, within a period of three months of his decision.

Provided, that in case the new lessee fails to make the payment o( compensation within stipulated period of three months the same shall be realised from him as arrears of land revenue for payment to the evictce

within six months from the date on which the compensation was awarded.

7. Govrnment may, be notification in the official gazette. direct that any power exerciseable by it under this regulation may be exercised also by any authority or officer subordinate to it.

8. It any officer authorised to take action under this regulation requires police assistant the exercise of his powers, there under, he may sent requisition to the officer in charge of police station shall on such requisition render the assistance required.

9. No person shall be prosecuted for contravention of any of the provisions of this regulation except with the prior approval writing. of the Zonal Administrator, Martial Law or a person authorised by him in this behalf.

10. The Chief Martial Law Administrator any person authorised by him in this behalf may make rule for carrying out the purposes of this regulation.

1 1. convention of any of the provision of this regulation shall be punished with regorous imprisonment for a term which may extended to six years, or with five, or with both.

India Won't be allowed to capture smallest part of E. Wing.

Rawalpindi. Nov. 7(PPI) : Begum Akhtr solaiman, daughter office Late Husseyen Shaheed Suhrawardy has said that the, people and valiant forces of- Pakistan will never allow India to capture even smallest portion of East Pakistan in order to install a proper ,government of so called "Bangladesh" there.

Talking to a PPI correspondent before her departure for Lahore she said if India would dare to attack Pakistan she would supper a more humiliating defeat than she sustained during the 1965 war, India, she continued, was trying to disintegrate Pakistan since its inception but she would never be able to achieve this purpose. She said that India could not establish the so-called -Bangladesh" government except in her own territory and if she would attempt to occupy a small portion of our territories for this purpose we will fight to the last.

Two wings will crush aggressor with pincer movement : Nurul Amin.

Sialkot. Nov. 7 (PPI) :"The two-wings of Pakistan are like brawny arms which will move co-ordinateclly to defend the country against any foreign incursion and Crush the aggressor with their pincer movement, declared Mr. Nurul Amin, President of the Pakistan Democratic party at a largely attended public meeting here today.

The PDP chief who is currently on a visit to West Pakistan, said the forces which had the audacity to misbehave with Pakistan, would be bowled out by the people arid the armed forces of this country who stood united to preserve national sovereignty and solidarity.

He assured the people of West Pakistan that patriotic elements of East Pakistan were ready to shed the last drop of their blood for safeguarding every inch of the sacred soil of their homeland. With such brave and dedicated people in both wings

no power on earth could defeat Pakistan he asserted.
