Rawalpindi, Nov. 7 : The chief Martial law administrator has issued a Martial law regulation (No.96) providing for eviction of unauthorised occupants of land. Following is the text of the regulation :
1. This regulation shall come into force at once and shall take effect. Not with standing anything inconsistent there with in any other law for the time being in force.
2. In this regulation, unless there is anything repugnant in the subject or context.
(a) 'Government' means the central Government or, as the case may be provincial Government;
(b) `Land' means any land ]eased out by the government for cultivation or horse, mule, cattle and sheep breeding conditions for the army remount department and include any buildings, hut houses, sheds and shelters constructed there on or appurtenant there to :
(c) `Lease' and 'Lessee' have same meanings as respectively assigned to these
words in the Transfer of property Act, 1882 (IV of 1882) mid the term 'Lessee' shall include his heirs, assigness leagel representatives and all persons inducted by him into the land of which he is the lessee :
(d) 'Unauthorised occupants' means a person whose lease of' land has expired or is terminated in accordance with the terms or due to breach of conditions or size of his stud having been reduced by who is still in possesion of the land and includes.
(i) A person in occupation of any land without the express permission Or authority of the Government and the heirs, successor's or arrives of such a person : and
(ii) A person who has taken possession of any land from any such person.
3. (i) Whether before or after the Commencement of this regulation an unauthorised
occupant of-
Provided that, before such eviction, one month notice shall be served on the unauthorised occupant calling upon him to deliber vacant and unencumbered possession of the land immediately after the expiry of the said period.
(2) Notwithstanding anything contained in sub-
Court and a High Court, shall be taken posession of until after, and in conformity
with the decision of such court or the tribunal to which such suit or proceeding
may be transferred under sub-
(3) A Zonal administrator of Martial Law may transfer from any Court including the
supreme court and a High court in which any such suit or proceeding as is referred
to in sub-
(4) A tribunal to which a suit or proceeding may be transferred under subparagraph (3) shall consist of :
(a) a Military officer not below the rank of a major who shall be the presiding officer and
(b) a Revenue officer or a civil judge
(5) A tribunal shall for the purpose of deciding the suit or proceeding transferred
to it, under sub-
(6) The decision of the tribunal shall be final and shall not be called in question by or before any court including the supreme Court and a High Court.
(7) An officer of the government shall give a notice of one month to vacating the land of which an occupant has been declared as unauthorised occupant. The period of notice shall start from the date the tribunal records its decision.
4. For the purpose of' recovering possession of any land on officer authorised by Government in this behalf may use or cause to be used such force as may he necessary.
5. If any rent payable in respect of any land has been in arrears on day of recovery of possession of such land, the amount chic on account of such arrears with interest, if any, accrued there on shall be recoverable as an arrear of land revenue.
6. The unauthorised occupant on his eviction may apply to the collector of the district in which the land may be situated, claiming compensation for any authorised buildings constructed, (other than those for private animals and their attendants, or well dug in, trees planted by him and crops uncut ungathered,on the land and the collector, whose decision in this behalf shall be final, shall determine the amount of such compensation to be paid by the new lessees of the said land, after affording such new lessees. government representatives and the evictus and opportunity of being heard, within a period of three months of his decision.
Provided, that in case the new lessee fails to make the payment o( compensation within stipulated period of three months the same shall be realised from him as arrears of land revenue for payment to the evictce
within six months from the date on which the compensation was awarded.
7. Govrnment may, be notification in the official gazette. direct that any power exerciseable by it under this regulation may be exercised also by any authority or officer subordinate to it.
8. It any officer authorised to take action under this regulation requires police assistant the exercise of his powers, there under, he may sent requisition to the officer in charge of police station shall on such requisition render the assistance required.
9. No person shall be prosecuted for contravention of any of the provisions of this regulation except with the prior approval writing. of the Zonal Administrator, Martial Law or a person authorised by him in this behalf.
10. The Chief Martial Law Administrator any person authorised by him in this behalf may make rule for carrying out the purposes of this regulation.
